Filing 7 AMENDED COMPLAINT against All Defendants, filed by Misty Coleman. (Caylor, Lydia) |
NOTATION ORDER: For good cause, the Court GRANTS Plaintiff's Motion for Leave to File Amended Complaint. This Court freely gives leave to amend complaints. Fed. R. Civ. P. 15(a)(2). This case was originally filed in the Hamilton County Court of Common Pleas on May 19, 2022. It was removed to federal court on June 6, 2022. Defendants moved to dismiss the complaint on June 15, 2022. On July 12, 2022, Plaintiff sought leave to amend the complaint. She requests leave to clarify the claims as they now exist in the context of a federal action. With this background, there is no apparent delay, bad faith, undue prejudice, or futility of amendment. Pittman v. Experian Info. Sols., Inc., 901 F.3d 619, 640 (6th Cir. 2018). The case is in its earliest stages. For that reason and because cases ought to be tried on their merits, the Court GRANTS Plaintiff's motion and DIRECTS her to file her amended complaint within 14 days of this Order. Signed by Judge Matthew W. McFarland on 07/20/2022. (kaf) |
