October 14, 2022 Notation Order: As stated in the Courts 10/12/2022 Minute Entry, the parties reached an agreement regarding resolution of the case, to wit: (i) Defendants will no longer enforce Subsection (J) of Policy No. 0169.1; (ii) Defendants will provide only one 30-minute public participation period at the Board of Educations upcoming 11/7/2022 meeting pursuant to current Policy No. 0169.1, without enforcing Subsection (J) of Policy No. 0169.1; (iii) as part of the 30-minute public participation period on 11/7/2022, Plaintiff Diane Hughes will be provided 3 minutes of uninterrupted time to speak; (iv) Defendants, however, reserve the right to remove public comment at any subsequent meetings or otherwise revise its public participation policy; and (v) Plaintiff agrees to seek no additional attorney fees or nominal damages in excess of her demand sent prior to the 10/10/2022 meeting, provided Defendants comply with (i)-(iv).
