NOTATION ORDER: This matter is before the Court on the parties' #5 Stipulated Extension of Time For Defendant Columbus Industries, Inc. to Answer, Move or Otherwise Plead to Plaintiff's #1 Complaint. Contrary to the representation made in the stipulation, review of the docket confirms that the statutory agent for Columbus Industries was served on 11/21/2022 (cf. Doc. 4-1), requiring a response by 12/12/2022. See Fed. R. Civ. P. 12(a)(1)(A)(i). S.D. Ohio Civ. R. 6.1(a) would then permit a stipulated extension of time to 1/3/2023 (taking into account observance of the New Year's Day holiday on 1/2/2023), but not to 1/12/2023. Accordingly, the Court will construe the parties' #5 Stipulated Extension of Time as an unopposed motion by Columbus Industries for an extension of time to respond to Plaintiff's #1 Complaint. Defendant Columbus Industries, Inc. shall answer, move or otherwise plead to Plaintiff's Complaint on or before 1/12/2023. Signed by Judge Michael R. Barrett on 12/9/2022. (kkz)
