| Filing 4 REPORT AND RECOMMENDATIONS re #3 Complaint filed by RaSaon Carr. IT IS RECOMMENDED: (1) Plaintiff's complaint is legally frivolous and fails to state any claim for relief under 18 U.S.C. 1030(g) against Defendant, OneTouchPoint, under the screening standards of 28 U.S.C. 1915(e)(2)(B). For that reason, his federal claims should be dismissed with prejudice. Alternatively, and to the extent that the district court prefers to dismiss for lack of federal jurisdiction rather than for failure to state a claim under 1915(e)(2)(B), Plaintiff's federal claims should be dismissed without prejudice; (2) The Court should decline to exercise jurisdiction over any related state law claims. Any state law claims that may exist should be dismissed without prejudice; (3) The Court should certify, pursuant to 28 U.S.C. 1915(a)(3), that an appeal from this decision could not be taken in good faith.
