Because the Court's decision does not rely on the Second Declaration of Ignazio Cangialosi, the Court need not address Plaintiffs' Motion to Strike And/Or Disregard Certain Affidavit Testimony of Defendant Nick Cangialosi (Dkt. 35 ), which is hereby DENIED as moot.
