Filing 23 OPINION AND ORDER: The Motion of Defendant WorkHealth North to 10 Dismiss Plaintiff's First Amended Complaint is GRANTED. Plaintiffs claims for negligence, tortious interference with an employment relationship, intentional or negligent inflict ion of emotional distress, and punitive damages are DISMISSED as against WorkHealth. The Motion of Defendant WorkHealth North 7 to Dismiss Plaintiff's Complaint is DENIED as moot in light of Plaintiff's First Amended Complaint and this Op inion and Order. Plaintiffs' Motion 12 to Amend the Complaint is GRANTED to the extent that Plaintiffs may pursue their cause of action against WorkHealth for breach of contract under a third-party beneficiary theory.
