Filing 23 REPORT AND RECOMMENDATIONS re 22 Amended Complaint: It is RECOMMENDED that the Court DISMISS all claims for monetary damages against the Individual Defendants in their official capacities and any claims based solely on a Defendant's supervis ory capacity. It is FURTHER RECOMMENDED that Plaintiff's negligence claim under state law against the Individual Defendants be DISMISSED WITHOUT PREJUDICE to renewal should the Ohio Court of 8 Claims determine that the state employees are not en titled to immunity under O.R.C. § 9.86.
