April 6, 2026 Opinion or Order NOTATION ORDER - This matter is before the Court on Plaintiff's Motion for Extension of Time (doc. #14 ). Upon initial review, it appears that Plaintiff seeks an extension of time in which to comply with this Court's Order of 3/11/2026 (doc. #12 ) with respect to the submission of completed service forms for Defendants Hogan, Johnson, and Edwards. A review of the Court's docket finds that the Clerk of Court received completed summons and USM 285 forms from Plaintiff on 3/25/2026 (doc. #13 ). However, a review of these forms finds that they were not properly completed by the Plaintiff. Specifically, on both the summons and the USMS 285 forms, the section on the forms where the name and address of the Plaintiff should be listed instead contains either the name and address of the Defendant (on the summons) or other information pertaining to the place of work and work hours of the Defendant (on the USM 285 forms). As these forms were not completed correctly by the Plaintiff, the undersigned finds granting Plaintiff additional time to correctly prepare and resubmit the service forms to be appropriate. Accordingly, Plaintiff's motion for extension of time (doc. #14 ) is GRANTED. Plaintiff is granted an additional thirty (30) days from the date of this Order, or through and including 5/6/2026, in which to prepare and resubmit completed service forms for Defendants Hogan, Johnson, and Edwards, in accordance with the Court's Order of 3/11/2026 (doc. #12 ). January 8, 2026 Opinion or Order Filing 9 ORDER - The Undersigned determines that Plaintiff, in an abundance of caution, may PROCEED at this juncture on his First Amendment retaliation claims and access to the courts claims against Defendants Hogan, Johnson, and Edwards for allegedly taking adverse action against Plaintiff for filing a civil complaint and denying him access to file future complaints. But Plaintiff has not yet provided the required service documents for these Defendants. Plaintiff is therefore ORDERED to provide a completed summons form, a completed U.S. Marshal form, and a service copy of the Amended Complaint (Doc. 6-1) for each of these three Defendants Hogan, Johnson, and Edwards. Plaintiff must submit these documents WITHIN 30 days of the date of this Order with a motion to issue service. The Clerk of Court is DIRECTED to send Plaintiff three blank copies of the summons form and the U.S. Marshal form for his use; REPORT AND RECOMMENDATIONS - IT IS RECOMMENDED that Plaintiff's remaining claims be DISMISSED, including the following: (1) Official capacity claims for monetary damages against Defendants Hogan, Johnson, and Edwards; and (2) Any claims against Defendant Chambers-Smith for the failure to state a claim upon which relief may be granted.
