September 30, 2009 Opinion or Order Filing 76 ORDER WITHDRAWING REPORTS AND RECOMMENDATIONS - It is accordingly ordered: 1. Plaintiff's Rule 26(A)(1) Initial Disclosures shall be scanned and docketed forthwith; 2. The Report and Recommendations (Doc. No. 60) and Supplemental Report and Reco mmendations (Doc. No. 71) are withdrawn. 3. If Plaintiff intends for future filings to make service on Defendants through the Court's electronic filing system, his certificate of service must reflect that fact and could properly read, if true, "I hereby certify I served the foregoing on the Defendants by filing it with the Clerk for scanning." The form of certificate of service which Plaintiff has been using in which he states "I hereby certify that the foregoing was either electronically filed, mailed by regular mail Postal service, and or hand delivered on this ___ day of ___, 2009" is unacceptably confusing. September 24, 2009 Opinion or Order Filing 74 ORDER - This Fair Credit Reporting Act case is before the Court on Plaintiff Todd Harrison's Objections (Doc. No. 73) to the Magistrate Judge's Supplemental Report and Recommendations (Doc. No. 71) recommending for the second time that this case be dismissed without prejudice. In his Objections to the Supplemental Report, Plaintiff now says that he actually filed disclosures and a settlement demand on July 8, 2009. Exhibit B-1 to Doc. No. 73 is a one-page document labeled "Plaint iff Rule 26(A) Initial Disclosures" and bears what appears to be the impression of the Clerk's hand stamp used on copies returned to filers of manually filed documents. The document now attached as Exhibit B-1 to the Objections was not doc keted by the Clerk, although the other three documents were. If Exhibit B-1 is genuine, then the Plaintiff did comply with the Court's Scheduling Order and the Reports and Recommendations should be withdrawn. In order to determine the genuinen ess of Exhibit B-1, the Plaintiff is ORDERED to deliver to Deputy Clerk Phil Butler the original document from which he made Exhibit B-1 not later than October 1, 2009. To avoid further difficulties of this sort, it is further ORDERED: that the Cler k shall, after time-stamping any documents filed by Plaintiff and scanning and docketing them, preserve the timestamped original. Before time-stamping any copies of documents tendered by the Plaintiff, the Clerk shall satisfy himself that every copy so stamped is in fact an exact copy of the original. June 24, 2009 Opinion or Order Filing 49 ORDER TO SHOW CAUSE AND CANCELLING PRETRIAL CONFERENCE - It is accordingly ORDERED: 1. The preliminary pretrial conference set for June 30, 2009, is CANCELLED. The Court's internal telephone system will not handle the number of parties involved in this case. The Court does not wish to incur the expense of arranging a conference call with an outside vendor if it is unclear whether Plaintiff will participate. 2. Defendants' counsel shall advise the Court forthwith whether Plaintiff has p rovided the disclosures required by Fed. R. Civ. P. 26(a)(1). 3. Plaintiff is ordered to advise the Court in writing not later than July 8, 2009, of any specific objections he has to the proposed deadlines in the Rule 26(f) Report filed by Defendants ' counsel and, if so, of his alternative proposals. In the absence of any objections, the Courtwill enter a scheduling order consistent with that Report and Judge Rice's schedule. 4. Not later than July 8, 2009, Plaintiff shall show cause w hy he should not be sanctioned for his failure to comply with the Order for Preliminary Pretrial Conference. Plaintiff is expressly cautioned that any further failure to comply with procedural orders of the Court will result in a recommendation that this case be dismissed.
