ORDER DISSOLVING STAY; REPORT AND RECOMMENDATIONS - On April 22, 2010, the Sixth Circuit entered an Order in that case denying relief (Docketed in S.D. Ohio Case No. 3:04-cv-275, Petitioner's prior habeas corpus case). Accordingly, the stay of t hese proceedings is DISSOLVED. It is again recommended that the Petition herein be dismissed for lack of subject matter jurisdiction. Because reasonable jurists wouldnot disagree with this conclusion, Petitioner should be denied leave to appeal in forma pauperis and any requested certificate of appealability. ORDER - This habeas corpus case is before the Court on Petitioner's Motion to Stay a decision on the Magistrate Judge's Report and Recommendations pending Petitioner's application to the Sixth Circuit Court of Appeals for permission to file a successive petition. The Motion to Stay is GRANTED. Petitioner shall seek permission from the Court of Appeals not later than October 15, 2009, and shall keep this Court currently advised of the status of proceedings in the appellate court.
