REPORT AND RECOMMENDATIONS re 29 MOTION for Judgment on the Pleadings filed by AutoZone, Inc. - Based on the foregoing analysis, it is respectfully recommended that the Court conclude it does have subject matter jurisdiction of this dispute un der 28 U.S.C. § 1332, but that any claim of the Plaintiff is barred by AutoZone's immunity under Ohio Revised Code § 4123.74 and by the doctrine of res judicata.
