With respe ct to Plaintiffs access-to-the-courts claim -- premised on the denial of his motion for leave to file a delayed motion for a new trial in the Montgomery County Common Pleas Court due to Defendants alleged refusal to provide him with his legal mater ials -- the motion be GRANTED; 3.
