June 26, 2015 Opinion or Order Filing 18 SUPPLEMENTAL REPORT AND RECOMMENDATIONS - Reasonable jurists could differ on whether Eggers' statement during allocution is a sufficient protestations of innocence to require application of Alford to this case. Eggers should be issued a certifi cate of appelability on that question. Because reasonable jurists would not disagree with the other conclusions reached in this and the original Report, Eggers should be denied a certificate of appealability on all other issues.
