TRANSFER ORDER - Because Petitioner is confined in Warren County, a place within this judicial district, he could properly filed his Petition in this Court. However, 28 U.S.C. 2241(d) provides that, in the exercise of its discretion and in furtherance of justice, the court in which a petition is filed may transfer the case to the other district court for hearing and determination. Because judicial personnel, both judges and clerks, are allocated on the basis of workload, it has been customary in Ohio to transfer habeas cases to the district in which the conviction occurred. This is particularly appropriate if there is a need for local witnesses to testify at an evidentiary hearing.Accordingly, in the exercise of its discretion, the Court orders this case TRANSFERRED to the United States District Court for the Northern District of Ohio, Eastern Division, at Cleveland.
