NOTATION ORDER: Upon agreement of the parties and considering their intention to preserve the status quo, the Court hereby STAYS the sale of the airplane identified in Plaintiff's complaint (doc. #2 ) until the Court rules on Defendant's motion to dismiss or holds a formal hearing on Plaintiff's motion for preliminary injunction. Additionally, the Court ORDERS Plaintiff to file an amended complaint on or before February 1, 2021. Defendant shall file a motion to dismiss and a memorandum in support, pursuant to Fed. R. Civ. P. 12(b), no later than seven days following the filing of Plaintiffs amended complaint. Plaintiff shall file a memorandum in opposition to Defendant's motion to dismiss no later than seven days following the filing of Defendant's motion to dismiss. Defendant shall file a reply memorandum no later than three days following the filing of Plaintiff's memorandum in opposition. Accordingly, Defendant's pending motion to dismiss (doc. #5 ) is DISMISSED AS MOOT WITHOUT PREJUDICE to re-filing. IT IS SO ORDERED. Signed by Judge Michael J. Newman on 1/27/2021. (srb)

| Minute Entry for proceedings held before Judge Michael J. Newman: This civil case came before the Court for an informal telephone conference regarding Plaintiff's motion for preliminary injunction on 1/25/2021. Argeri Atharasios Lagos appeared and participated on behalf of Plaintiff. Gregory R. Flax appeared and participated on behalf of Defendant. Plaintiff explained that this case arose from the failed sale of a private airplane. Plaintiff expressed concern that if Defendant sold the airplane before litigation concluded, it would suffer irreparable harm. The Court advised the parties it is aware of Defendant's motion to dismiss for lack of personal jurisdiction (doc. #5 ) and will decide the issue prior to holding a formal hearing on Plaintiff's motion for a preliminary injunction. The Court proposed -- and the parties agreed -- to stay the sale of the airplane until the Court renders a decision on Defendant's motion to dismiss or holds a formal hearing on Plaintiffs motion for a preliminary injunction. The Court advised the parties to work with court staff to set a formal preliminary injunction hearing date. The Court will issue an order by separate entry.
