Reset Deadlines as to #3 REPORT AND RECOMMENDATIONS. Objections to R&R due by 12/7/2021. (srb) |
Filing 6 Notation ORDER - because the prior notation order on objections to the Report and Recommendations was not served by the Clerk, Petitioner's deadline is extended to and including December 7, 2021.. Signed by Magistrate Judge Michael R. Merz on 11/9/2021. (MRM) |
Filing 5 Notation ORDER granting in part and denying in part #4 Motion for Extension of Time: Petitioner's time to object to the pending Report and Recommendations is extended to and including November 1, 2021, and no further.. Signed by Magistrate Judge Michael R. Merz on 10/07/2021. (MRM) |
Filing 4 Motion for Extension of Time to File Objection To Magistrate's Report and Recommendation by Petitioner, Michael Bell. New date requested 12/7/2021. (bjr) |
Filing 3 DECISION AND ORDER; REPORT AND RECOMMENDATIONS - The Public Records Request is DENIED because this Court is not the custodian of the requested record nor the court designated by Ohio law to enforce public records requests. The Motion to Take Judicial Notice is DENIED because the fact of which Bell asks the Court to take judicial notice is not the proper subject of judicial notice under Fed. R. Evid. 201. Because Bell's habeas corpus case is barred by the statute of limitations, it should be dismissed with prejudice. Because reasonable jurists would not disagree with this conclusion, it is also recommended that Petitioner be denied a certificate of appealability and that the Court certify to the Sixth Circuit that any appeal would be objectively frivolous and should not be permitted to proceed in forma pauperis. Objections to R&R due by 10/6/2021. Signed by Magistrate Judge Michael R. Merz on 9/22/2021. (kpf)(This document has been sent by regular mail to the party(ies) listed in the NEF that did not receive electronic notification.) |
