ORDER - It is ORDERED that the 5/31/2023 Order issued by the District Court for the Eastern District of Pennsylvania (Doc. #5 ) and petitioner's Motion for Immediate Release From Custody (Doc. #4 ) be docketed in Draper v. Newman, Case No. 1:23-cv-265; REPORT AND RECOMMENDATION - IT IS RECOMMENDED THAT: (1) Petitioner's duplicative petition for a writ of habeas corpus DISMISSED; (2) A certificate of appealability should not issue with respect any Order adopting this Report and Recommendation to dismiss the instant habeas corpus petition on the procedural ground of duplicativeness; (3) With respect to any application by petitioner to proceed on appeal in forma pauperis, the Court should certify pursuant to 28 U.S.C. 1915(a)(3) that an appeal of any Order adopting this Report and Recommendation would not be taken in "good faith," and, therefore, should DENY petitioner leave to appeal in forma pauperis upon a showing of financial necessity.
