Filing 9 ENTRY GRANTING PLAINTIFF JOHN W. HANSON III LEAVE OF COURT TO FILE SECOND AMENDED COMPLAINT. Federal Rule of Civil Procedure Rule 15 governs amended pleadings in federalcases and permits one amendment to pleadings as a matter of course. Fed. R. Civ. P. 15(a)(1). Other amendments can be made only with the opposing party's written consent or by leave of court. Fed. R. Civ. P. 15(a)(2). Plaintiff ordinarily may not amend without leave of Court or consent by all defendants, neither of which he sought. Ordinarily, this should result in Plaintiff's Second Amended Complaint being stricken from the record. However, after this Court's careful sua sponte review of both the First and Second Amended Complaints, it appears that the only alteration is the replacement of "General Motors" with "General Motors LLC" throughout and the addition of "GM LLC Attorney Thomas Lurie. " Given these de minimis alterations, the Court will nunc pro tunc grant Plaintiff the right to file his Second Amended Complaint, Doc. #7 . As the Second Amended Complaint does not alter the claims against the Dealer Defendants who filed the Motion to Dismiss, that Motion shall remain pending at this time as against the Second Amended Complaint. Plaintiff shall have up to December 26, 2024, to file a response and Dealer Defendants shall have 14 days thereafter to file any reply deemed necessary. Signed by Judge Walter H. Rice on 12/5/2024.
