ORDER by Chief Judge John E Dowdell No later than 30 days after this order is entered, plaintiff must either (1) file a 1983 civil rights complaint on the court-approved form and submit the $400 filing fee or a motion for leave to proceed in forma pauperis, along with an inmate account statement for the 6-month period immediately preceding the filing of the complaint, or (2) file a 2254 petition for writ of habeas corpus on the court-approved form and submit the $5 filing fee or a motion for leave to proceed in forma pauperis. If plaintiff does not intend to proceed with either action, he may instead file a written notice of dismissal indicating that he wants to voluntarily dismiss the complaint and terminate this action.
