Filing 76 ORDER: The Court ADOPTS Magistrate Judge Acosta's Findings and Recommendation 72 . Accordingly, the Court GRANTS Defendants Motion 57 for Summary Judgment as to Plaintiffs (1) claims under 42 U.S.C. § 1983 against Defendant Nooth , (2) claim under the Fourteenth Amendment of the United States Constitution against Defendant Taylor, (3) state common-law and constitutional claims, and (4) request for declaratory relief. The Court DENIES Defendants Motion as to (1) Plaintiffs Eig hth Amendment claims against Defendants Hartman, Ortega, Saldivar, and Brown, and (2) Plaintiffs request for punitive damages.
