ORDER - Plaintiff's Motion for Leave to File an Amended Complaint (ECF #18 ) is GRANTED. The Court directs the Clerk of Court to file Plaintiff's Amended Complaint (ECF #18 -1), which attached to Plaintiff's motion, on Plaintiff's behalf. Further, on August 28, 2020, Defendants filed a Motion to Dismiss under Rule 12(b)(6) of the Federal Rules of Civil Procedure. Defendants seek the dismissal of Plaintiff's claims other than Plaintiff's claim alleging a violation of 42 U.S.C. 1983. See ECF #13 . On August 31, 2020, Plaintiff responded to Defendant's Motion to Dismiss (ECF #14 ). The Court construes Defendants' Motion to Dismiss as also applicable against Plaintiff's Amended Complaint. Plaintiff has until October 1, 2020 to file an optional supplemental response explaining how his Amended Complaint cures the alleged defects Defendants identified in their Motion to Dismiss. Defendants will have 14 days following Plaintiff's filing of his supplemental response or the deadline for that response if none is filed, to reply in support of their Motion to Dismiss.
