Filing 9 JUDGMENT - Based on the Court's ORDER, IT IS ADJUDGED that this case is DISMISSED. Signed on 8/6/2020 by Judge Michael H. Simon. (Mailed to Pro Se party on 8/6/2020.) (mja) |
Filing 8 ORDER - On July 15, 2020, the Court dismissed Plaintiff Jose Castaneda's complaint with leave to amend certain claims (other claims were dismissed without leave to amend, including claims against state court judges) if Plaintiff could cure the deficiencies identified in the Court's Order (ECF #3 ). On August 3, 2020, Plaintiff filed a "Response" document (ECF 6) that purported to be a "writ of mandate" to certain state court judges, that purported to demand "audio tapes" under "Rule 11 (a-e)," that contained "objections" to the Court's Order of July 15th, and that purported to be pursuant to 28 U.S.C. 1915(a) or (d). Also on August 3, 2020, Plaintiff filed a supplemental objection and opposition (ECF #7 ). To the extent these documents were intended to be a motion for reconsideration of the Court's July 15th Order, such motion is DENIED. To the extent Plaintiff's filings were meant to be construed as an amended complaint, they fail to cure the deficiencies identified in the Court's Order and fail to comply with Rule 8 of the Federal Rules of Civil Procedure. Accordingly, for the reasons discussed in the Court's July 15th Order, if those filings were meant to be an amended complaint, that complaint is dismissed. Because the Court has already provided Plaintiff with the opportunity to amend, the Court finds that further amendment would be futile. This case is dismissed without leave to amend. Ordered by Judge Michael H. Simon. (Mailed to Pro Se party on 8/6/2020.) (mja) |

Filing 3 Opinion and Order - Plaintiff's application to proceed in forma pauperis (ECF #1 ) is GRANTED. Because Plaintiff fails to state a claim and his claims against certain Defendants are barred by sovereign and judicial immunity, this case is dismissed sua sponte. Plaintiff's claims against United State Magistrate Judge Steve Kim and all the state court judges are dismissed with prejudice and without leave to amend. Plaintiff's claim under 18 U.S.C. 241 and 242 is dismissed with prejudice and without leave to amend. Plaintiff's claims under 42 U.S.C. 1983 against the State of California, the California State Bar, and the Los Angeles Superior Court are dismissed with prejudice and without leave to amend. Plaintiff's remaining claims against the State of California, the California State Bar, and the Los Angeles Superior Court are dismissed without prejudice but without leave to amend in this Court. Plaintiff's remaining claims against the City of Los Angeles, the County of Los Angeles, Jack K. Conway, and Jan W. Anderson are dismissed without prejudice. Not later than July 31, 2020, Plaintiff may file an Amended Complaint if he can cure the deficiencies identified in this Opinion and Order. Signed on 7/15/2020 by Judge Michael H. Simon.
