Filing 58 ORDER - No party having made objections, this Court follows the recommendation of the Advisory Committee and reviews Judge Jelderk's Findings and Recommendation for clear error on the face of the record. No such error is apparent. Accord ingly, the Court ADOPTS Judge Jelderk's Findings and Recommendation, Dkt. 55 . Plaintiff's motion to stay (Dkt. 53 ) is DENIED and this action is DISMISSED without prejudice. The Court further finds that any appeal from this Order would not be taken in good faith and Plaintiff's in forma pauperis status should be revoked pursuant to 28 U.S.C. § 1915(a)(3). Filing 51 OPINION AND ORDER - The Court adopts the conclusions recommended by Judge Jelderks for the reasons stated herein. Plaintiff's Motion to Stay (Dkt. 43 ) is DENIED. Defendant's Motion to Dismiss (Dkt. 38 ) is GRANTED. Plaintiff' ;s first claim is DISMISSED with prejudice. Plaintiff's second claim is DISMISSED without prejudice.
