Filing 79 ORDER - Defendants' motion for summary judgment (ECF 49 ) is DENIED with respect to Plaintiff's claim that Defendant McCrae engaged in the unnecessary and wanton infliction of pain to Plaintiff in violation of the Eighth Amendment. Defendants' motion is GRANTED in all other respects. Plaintiff's motion for leave to file an amended complaint (ECF 63 ) is DENIED. Plaintiff's fifth motion for appointment of counsel (ECF 77 ) is DENIED. The Court has previously denied Plaintiff's motions for appointment of counsel. ECF 55 , 57 , and 62 .
