ORDER ADOPTING REPORT AND RECOMMENDATION of Magistrate Judge Carlson 5 , 2. GRANTING petitioner's petition for writ of habeas corpus 1 , & 3. W/in 15 days, respondents shall provide Petitioner w/ a hearing before an immigration judge where, if the gov't wishes to detain Petitioner during the course of her removal proceedings, it shall have the burden of proving that Ptnr is a flight risk or a danger to the community.
