February 1, 2024 Opinion or Order Filing 1 ORDER: IT IS HEREBY ORDERED THAT: 1. Plaintiff's amended complaint (in Civil Action No. 23-403; Doc. 37) is deemed improperly filed in that case; 2. The Clerk of Court is directed to open a new case and docket plaintiff's amended complaint (Doc. 37) as the complaint in the new case; 3. Clerk of Court is directed to docket this order in the new case in addition to docketing this order in the above-captioned case; 4. Clerk of Court is directed to subtract the $402 filing fee paid by plaintiff on November 15, 2023 from the fees that have been paid in the above-captioned case and instead apply the $402 payment to the filing fee in the new case; 5. Clerk of Court is directed to treat the new case as fully paid pursuant to the $402 payment made on November 15, 2023; 6. Clerk of Court shall add a docket annotation to the new case indicating that the filing fee has been paid pursuant to the November 15, 2023 payment; 7. Plaintiff's motion to compel docketing of his paid complaint (Doc. 40) is DENIED as moot; 8. The Court's prior dismissal of the above-captioned action as malicious pursuant to 28 U.S.C. 1915(e)(2)(B)(i) shall remain in effect and shall not be reconsidered Signed by Honorable Christopher C.
