Defendants' motion is GRANTED with respect to Plaintiff's First Amendment retaliation claim to the extent said claim is premised upon Defendant McConnell's actions in issuing an allegedly false misconduct against Plaintiff; 2. Defendants' motion is GRANTED insofar as it relates t o Plaintiff's Fourteenth Amendment due process claims; 3. Defendants' motion is GRANTED insofar as it relates to Plaintiff's Fourteenth Amendment equal protection claims; 4. Defendants' motion is GRANTED insofar as it relates to P laintiff's claim for compensatory damages; and 5. Defendants' motion is DENIED in all other respects. IT IS FURTHER ORDERED that the Plaintiff's motion for summary judgment 77 shall be, and hereby is, DENIED without prejudice to be reasserted upon a more fully developed record.
