Filing 108 MEMORANDUM OPINION & ORDER re 89 MOTION to Compel Discovery filed by SHAWN L. WILLIAMS. The motion will be GRANTED IN PART and DENIED IN PART. The motion to compel is DENIED as to Requests No. 4 and 5. The motion to compel the production of the housing unit log entries is DENIED. As to Request No. 13, Defendants already have complied with the request and the motion as it relates to this request is DENIED AS MOOT. To the extent an updated version of the procedures was in effect in 2015, and notwithstanding its potential availability through other means, the motion to compel is GRANTED as to this request, and Defendants are ordered to produce the updated version to Williams within fourteen (14) days of the date of this Order. The motion to compel as to Request Nos. 6 & 9 is DENIED as to this request with the understanding that the Court retains the authority to take proper action if it is later determined that any party has wrongfully withheld responsive documents or provided untru thful or misleading responses to discovery. Williams' motion to compel is DENIED as to interrogatory No. 3. Plaintiff's motion to compel answers to Interrogatories 5, 7, 8, 9 and 11 is DENIED. Plaintiff's motion to compel answers to I nterrogatories 1,9,11 & 12 is DENIED AS MOOT as to this request with the understanding that the Court retains the authority to take proper action if it is later determined that any party has wrongfully withheld responsive information or provided untr uthful or misleading responses to discovery. The Court will DENY the motion as to Interrogatory 2 and 12. The motion to compel is DENIED as to Interrogatory 10. The motion to compel as to Request Nos. 4 & 6 is DENIED. The Court will DENY Williams' motion to compel the production of the DOC policies 6.3.1. The motion to compel is DENIED as to request No. 11 and Request Nos. 16-22 are DENIED. Filing 65 ORDER: Upon consideration of Defendants' 53 Motion to Sever, and the Plaintiff's 57 Response thereto, the Motion is GRANTED as follows:1. The Clerk is hereby instructed to TERMINATE the following misjoined Defendants from this action: C.O. Villegas, P.S.S. Knight. 2. Should the Plaintiff wish to proceed with any separate lawsuits against misjoined Defendants Villegas and Knight, he may do so by initiating separate actions in accordance with the Federal Rules of Civil Procedure. 3 . The Complaint, filed at Case No. 1 :17-cv-204, shall proceed against Defendant Beddick and Supervisory Defendants Giroux, Clark, Franz, Meure, Irwin, Jones, Anders, Bashor, Szelewski, and Kusiak. 4. The claims stated in this Complaint against Defen dants Hammett and Harmon at ECF No. 4 are hereby SEVERED. The Plaintiff has thirty days from the date of this order to refile these claims as separate actions. 5. The Defendants remaining at Case No. 1: 17-cv-204 shall file an answer, motion to dismiss, and/or any other relevant pleadings on or before Friday, November 30, 2018. 6.
