IT IS FURTHER ORDERED that if Plaintiff still desires to appeal the Court's Scheduling Order and the Orders denying his motions regarding discovery, then he mu st file a Notice of Appeal to the Third Circuit Court of Appeals and either pay the $505.00 filing fee or submit a motion for leave to proceed in forma pauperis on appeal. Filing 73 ORDER granting in part, denying in part, and denying without prejudice in part 49 Motion to Dismiss for Failure to State a Claim. It is further ORDERED that all claims in Plaintiff's Second Amended Complain are dismissed with prejudice except for Plaintiff's retaliation claims against Defendants Cowan, Nickolas, Swartz, Macknair, Staley, Guyton, Burris, Winfield, Matthews, Bupka, Baker, Mitchell and Rogers. It is further ORDERED that Defendants may reassert their argument regarding exhaustion of administrative remedies in a properly filed motion for summary judgment. It is further ORDERED that the Clerk shall direct the United States Marshal to mail a copy of Plaintiff's Second Amended COmplaint, notice of lawsuit and requ est for waiver of service of summons, and waiver, to Defendants Rogers, Guyton and Burris.
