Filing 9 MEMORANDUM ORDER - IT IS ORDERED that Plaintiff's objections [Doc. #8 ] to the Magistrate Judge's Report and Recommendation [Doc. #7 ], hereby are overruled; and, IT FURTHER IS ORDERED, for the reasons set forth in the Magistrate Judge's Report and Recommendation [Doc. #7 ], which is adopted as the opinion of the Court, that Petitioner Mack Shedd's petition for a writ of habeas corpus pursuant to 28 U.S.C. Section 2254 [Doc. #6 ] hereby is dismissed; and, IT FURTHER IS ORDERED that a certificate of appealability likewise is denied as Petitioner has failed to make a substantial showing of the denial of a constitutional right or to show that reasonable jurists would find it debatable whether this Court's procedural ruling dismissing this case for lack of jurisdiction is correct. Slack v. McDaniel, 529 U.S. 473, 484 (2000). See 28 U.S.C. Section 2253(c)(2); Fed.R.App.P. 22(b). The Clerk of Court shall mark this matter closed, and as more fully stated in said Memorandum Order.
