Filing 17 REPORT AND RECOMMENDATION of Magistrate Judge Mary Gordon Baker. It is recommended that the BCSO Defendants' #4 Motion to Dismiss be GRANTED IN PART AND DENIED IN PART. Specifically, the 1983 claims against BCSO and Lewis should be dismissed in their entirety. However, the state law claims against these Defendants should remain pending. The undersigned further recommends that the Officer Defendants' #13 Motion to Dismiss be GRANTED IN PART AND DENIED IN PART. Specifically, the 1983 claims against Becker, Jurgensmeyer, and Thompson should be dismissed to the extent they are brought against them in their official capacities. The 1983 claims for excessive force, racial discrimination, retaliation, and abuse of process brought against the Officer Defendants in their individual capacities should remain pending, as well as the state law claims brought against them. Objections to R&R due by 6/3/2020. Add an additional 3 days only if served by mail or otherwise allowed under Fed. R. Civ. P. 6 or Fed. R. Crim. P. 45.
