Filing 35 MEMORANDUM OPINION AND ORDER granting 30 Motion for Leave to File; granting in part and denying in part 13 Motion to Dismiss for Failure to State a Claim. Plaintiffs' DTPA and CWA claims are DISMISSED WITHOUT PREJUDICE. Plaintiffs have l eave to amend their pleading by 3/12/2018. Because the Court's 11/20/2017, Order stayed the case pending the resolution of Defendants' Motion to Dismiss, (ECF No. 23 ), the stay is therefore LIFTED. The parties are directed to confer and submit a revised joint proposal for the contents of a scheduling order, by 3/22/2018. (Ordered by Chief Judge Barbara M.G. Lynn on 3/1/2018) (epm) |
Filing 34 MEMORANDUM OPINION AND ORDER: The Court will not permit Plaintiffs to join the City of Dallas. All claims asserted against the City in the Amended Complaint are DISMISSED WITHOUT PREJUDICE, and the City's 28 Motion to Dismiss is DENIED as moot. Since there is complete diversity, Plaintiffs' 19 Motion to Remand is DENIED. Furthermore, Plaintiffs' request for attorney's fees is DENIED. (Ordered by Chief Judge Barbara M.G. Lynn on 2/21/2018) (axm) |
