Samuelson's civil-rights claims will proceed in this action, and his habeas claims will be severed and considered in a new civil action. The Court DIRECTS the clerk of Court to: (1) open a new civil action (Nature of Suit 530); and (2) docket a copy of Samuelson's habeas petition (ECF No. 11 ), application to proceed in forma pauperis (ECF No. 12 ); and this order in the new civil action.
