Filing 7 JUDGMENT: For the reasons stated in the Court's order entered today, it is ordered, adjudged, and decreed that Plaintiff's civil-rights complaint is dismissed without prejudice under 28 U.S.C. 1915(e)(2)(B). (Ordered by Judge James Wesley Hendrix on 12/15/2023) (bdg) |
Filing 6 ORDER: The Court finds that the complaint must be dismissed. Rios is not a lawyer and cannot represent others in court. So, since he only raised claims on behalf of Garcia, he has failed to state a claim upon which relief may be granted. This dismissal will not prejudice Garcia's right to pursue claims on his own behalf. The Court warns Rios that he is not a lawyer and that he may not file papers on behalf of other prisoners. Any future attempts to do so may constitute the unauthorized practice of law, which carries potential criminal penalties. The Court also warns Rios that if he persists in filing frivolous lawsuits or motions, the Court may impose sanctions including monetary sanctions, a complete bar to filing, or both. The complaint is dismissed without prejudice2 under 28 U.S.C. 1915(e)(2)(B)(ii) & 1915(g). Any pending motions are denied. This dismissal will count against Rios as a qualifying dismissal - or strike- under 27 U.S.C. 1915. The Clerk is directed to mail a copy of this order and judgment to Rios at the Lubbock County Detention Center and to Garcia at the address provided in Dkt. No. 1 at 7.
