ORDERED that plaintiff's application to proceed in forma pauperis #7 be and is GRANTED and plaintiffs complaint is deemed filed as of this date; and it is further ORDERED that plaintiff's correctional institution send to the Clerk an initial filing fee of $20.11 and thereafter to submit twenty percent (20%) of plaintiffs preceding month's income any time his monthly account balance is at least $10.00 until the full $350.00 filing fee has been paid; and it is further ORDERED that the Clerk arrange for service of process upon defendants in accordance with the April 30, 2020 Agreement on Acceptance of Service between the Clerk of this Court and the Office of the Attorney General for the Commonwealth of Virginia (the "Service Agreement"); and it is further ORDERED that defendant file an answer or other responsive pleading to the complaint in accordance with the attached Waiver of the Service of Summons; and it is further ORDERED hat, within twenty-one (21) days of defendant filing a responsive pleading, plaintiff file any opposition, including counter-affidavits (see Order for further details). ORDERED that plaintiff is assessed a filing fee of $350.00 and an administrative fee of $52.00, pursuant to 28 U.S.C. 1914(a); that plaintiff's request to proceed IFP is conditionally granted to the extent that plaintiff need not prepay the filing fee at this time; Plaintiff is directed to sign and return the attached form consenting to the withdrawal of funds from his inmate trust account as well as the attached application to proceed IFP; If the Court grants plaintiff IFP status, he will be required to pay the filing fee in installments after first paying an initial filing fee, and the $52 administrative fee will be waived; that the Clerk request that plaintiff's institution of confinement complete the attached Inmate Account Report Form regarding plaintiff's inmate account within thirty (30) days of the date of this Order; that plaintiff's failure to comply with any part of this Order within thirty (30) days from the entry of this Order, or failure to notify the Court immediately upon being transferred, released, or otherwise relocated, may result in the dismissal of the complaint pursuant to Federal Rule of Civil Procedure 41(b).
