July 20, 2009 Opinion or Order Filing 91 MEMORANDUM OPINION AND ORDER re: 90 Plaintiff's OBJECTION and REQUEST for Clarification of 89 Memorandum Opinion and Order. Plaintiff objects to the court's Order of 7/8/09, vacating Magistrate Judge VanDervort's appointment of an expert pursuant to Federal Rule of Evidence 706. To the extent plaintiff's objections are an invitation for the court to revisit its earlier ruling, the court declines to do so. Having reviewed the record herein, including the hearing of 12/2/08 , and Dr. Siddiqi's deposition in its entirety, the court is not persuaded that it needs to appoint an independent expert in this case. Plaintiff has also asked the court for clarification of its Order of 7/8/09. The court believes that there is nothing in its Order to suggest that the court has eliminated plaintiff's need for a medical expert when one is otherwise required. Signed by Senior Judge David A. July 8, 2009 Opinion or Order Filing 89 MEMORANDUM OPINION AND ORDER re: 88 United States' objections to the 12/30/08 Order of Magistrate Judge VanDervort. The Court SUSTAINS the government's objections. The Court finds that appointment of a Rule 706 expert is unnecessary and VACATES the magistrate judge's appointment of one in this case.
