MEMORANDUM OPINION AND ORDER: for the reasons set forth herein, the motions are granted in part and denied in part; the court DENIES defendants' 7 and 10 MOTIONS to Dismiss and/or Stay inasmuch as they request dismissal and GRANTS the moti ons to the extent they request a stay. This action is STAYED pending disposition of the related suit currently pending in the Circuit Court of Mercer County, West Virginia and the Clerk is directed to remove the case from the court's active docket.
