Filing 25 MEMORANDUM OPINION AND ORDER: The court GRANTS defendants' 19 MOTION for Leave to File a Surreply and DENIES plaintiff's 18 MOTION to Strike. The plaintiff's 11 MOTION for Leave to Amend is GRANTED in part and DENIED in part to t he extent that Counts IV, V and VI are futile. Within seven (7) days of entry of this Memorandum Opinion and Order, the plaintiff is DIRECTED to file a complaint consistent with this Memorandum Opinion and Order to more accurately identify which defendants are charged in each of the remaining causes of action.
