March 7, 2022 Opinion or Order Filing 4 ORDER directing Petitioner to complete and file a Bivens complaint within thirty (30) days of the date of this Order if he wishes to pursue his conditions of confinement claims. If Petitioner is unable to afford the $400 filing fee, he should submit an Application to Proceed Without Prepayment of Fees and Costs that reflects his current financial status. Upon receipt of the above-stated paperwork, the Clerk is directed to open a new civil action in the Bluefield division and designate it as a civil rights case filed pursuant to Bivens. If Petitioner wishes to pursue a motion for compassionate release, he must file it in the court where his underlying criminal conviction and sentence are imposed. If Petitioner no longer wishes to pursue this action, he should file a Motion advising the Court that he prefers to dismiss this case and asking for an order of voluntary dismissal.
