Filing 46 MEMORANDUM OPINION AND ORDER granting defendant United States Postal Service's 35 MOTION for Summary Judgment as to Carte's claims under the Privacy Protection Act, the Privacy Act, the Health Insurance Portability and Accountability Act, and the West Virginia Human Rights Act; dismissing each of these claims with prejudice, with the exception that Carte's Privacy Act claim be dismissed without prejudice so as to permit him to pursue any remaining administrative remedy that he m ay have under FECA related to the events that gave rise to this civil action; directing that the United States of America, the United States Postal Service, and this action in its entirety is dismissed.
