MEMORANDUM OPINION AND ORDER granting in part and denying in part defendants' 5 MOTION to Dismiss as more fully set forth herein; the motion to dismiss based on collateral estoppel is denied; directing that the plaintiffs' claims agains t the City of Charleston, the Charleston Police Department, and the individual police officers in their official capacities are barred by res judicata and are dismissed; the claims against the police officers in their individual capacities are entitled to qualifed immunity; directing that Counts X, XI, XII, and XIV of the complaint are dismissed.
