MEMORANDUM OPINION AND ORDER directing that the 5 Proposed Findings and Recommendation by Magistrate Judge are adopted and incorporated in full; plaintiff's 2 Motion for "'Actio' Damni Injuria Procedure Torts" is denied ; this action is dismissed with prejudice for lack of federal subject matter jurisdiction and removed from the docket of this court; and plaintiff Jeremy W. Kelly is WARNED that the continued filing of civil actions concerning his Indiana criminal or habeas corpus proceedings, over which this court lacks jurisdiction and venue, may result in the imposition of a pre-filing injunction prohibiting the plaintiff from filing any additional petitions or motions concerning such claims in this court, or other sanctions.
