ORDER AND NOTICE directing plaintiff to either pay the $400 filing fee or complete and file an Application to Proceed Without Prepayment of Fees and Costs by 11/25/2020. Plaintiff is NOTIFIED that his #1 Complaint, as presently pled, fails to state a claim upon which relief can be granted. The undersigned FINDS, however, that the interests of justice require that the plaintiff be given an opportunity to amend his Complaint to assert claims that are actionable in this court and are asserted in the proper format. Plaintiff is granted leave to file an Amended Complaint, as more specifically set forth herein, and is to do so by 11/25/2020. Failure to comply with this Order will result in the undersigned's recommendation that this matter be dismissed for failure to prosecute. The Clerk is to mail a blank Application to Proceed Without Prepayment of Fees and Costs and a section 1983 Complaint form styled as an "Amended Complaint," with the plaintiff's name, OID number, and the case number, but otherwise left blank.
