Filing 65 Judge Allison D. Burroughs: ELECTRONIC ORDER entered Plaintiff's motion to join Pryor Cashman LLP as a defendant to this action #53 is DENIED substantially for the reasons articulated in Defendants Lyor Cohen, Theory Entertainment, LLC, Warner Bros. Entertainment, Inc., and Warner Music Group Corp.'s opposition #64 . Specifically, Plaintiff has not plausibly alleged that Pryor Cashman is liable for any alleged infringement, and Pryor Cashman is not a "required party" under Fed. R. Civ. P. 19(a)(1)(A). Further, on May 1, 2015, after Plaintiff had purported to amend his complaint numerous times before serving it, the Court ordered Plaintiff not to file any further motion to amend until after the original seven defendants had been served with and had an opportunity to respond to the complaint. [Docket no. 26, at 3.] As the defendants' responses to the complaint have not been filed and are not due until July 17, 2015, Plaintiff's latest motion is precluded by the May 1, 2015 Order. In accordance with the May 1, 2015 Order, and pursuant to the Court's inherent authority to manage its own docket, Plaintiff shall not file any further motion to amend, motion to join parties, motion for summary judgment, or other substantive motions until after the original seven defendants have had an opportunity to respond to the complaint. The remaining requests in Plaintiff's motion, including that the Court suspend the pro hac vice admission of attorney Tom Ferber of Pryor Cashman and commence disciplinary proceedings against Pryor Cashman, are also DENIED. Burroughs: ELECTRONIC ORDER entered Plaintiff's Opposition to Defendants' Motion to Admit Counsel Pro Hac Vice and Motion to Join a Required Party #53 will not be considered on an ex parte basis, as the Court finds that there is no good cause for ex parte consideration. By July 2, 2015, Defendants may file an opposition to this motion. Further, Plaintiff's Motion to Vacate Order and Opposition to Defendants' Motion to Strike Plaintiff's Motion for Partial Summary Judgment #52 is DENIED. The Court will not rule on the merits of a summary judgment motion before the defendants have had an opportunity to answer or otherwise respond to the complaint. See Fed. R. Civ. P. 56(b). The summary judgment motion was struck without prejudice to renewal at a later time. The Court further directs Plaintiff that pleadings (including motions and other filings) will not be considered on an ex parte basis unless the Court finds good cause to do so.
