As the Court noted in its memorandum and order dated February 11, 2016, the affidavits submitted by plaintiff can be read to state that the probable cause of her injury was inherently unknowable until December 14, 2010. More precisely, according to a generous interpretation of the affidavits of plaintiff's experts, she knew as of the date of birth (June 18, 2009) that she either had a temporary (naturally caused, and therefore not compensable) or permanent (not naturally caused, and therefore compensable) injury, but had no way of knowing, even through the exercise of reasonable diligence, which kind of injury she had. While there is certainly reason to question whether that proposition is true, it is enough to create a genuine dispute as to a material fact and therefore to deny summary judgment. (Pezzarossi, Lisa)
