Cisco seeks to strike portions of Egenera's infringement expert report that identify, in addition to the two features described in Egenera's infringement contentions, four other aspects of Cisco's accused Fabric Interconnect product as allegedly infringing the message modification and transmission limitation of asserted claims 1-8. Cisco contends that these disclosures constitute novel infringement theories, and that Cisco is prejudiced because it received no notice of and did not have the opportunity to investigate these theories during fact discovery. For its part, Egenera argues that the four additional features are merely applications of the infringement theory that it has consistently disclosed in its contentions, namely, that "Cisco's UCS Fabric Interconnect is the control node capable of modifying storage messages." Opp'n at 10, and that Cisco had sufficient notice of these four features being accused because they were described in documents that Egenera listed as reflecting the infringing features. The court agrees with Cisco that merely stating an accused product generally infringes a claim limitation does not provide sufficient notice of a patentee's infringement theory. See, e.g., L.R. 16.6(d)(1)(A)(iii) (June 1, 2018) (requiring infringement claim chart to include "an element-by-element description of where and how each element of each asserted claim is found in each accused product or method"). However, the court agrees with Egenera that Cisco has not identified any concrete prejudice to warrant the sought remedy. Cisco's expert indicated in deposition that he does not believe he lacked any information to formulate his responsive nonfringement expert report. Cisco's contention that it could have searched for additional prior art or sought additional claim construction had it known these theories earlier is too speculative. In any case, the Federal Circuit has long cautioned district courts to construe claims "without reference to the accused device." SRI Int'l v. Matsushita Elec. Corp. of Am., 775 F.2d 1107, 1118 (Fed.
