November 20, 2014 Opinion or Order Filing 45 Judge Mark G. Mastroianni: MEMORANDUM AND ORDER entered. The Court GRANTS Pltf's - 9 Motion for P.I., insofar as it seeks to enjoin Defts' from utilizing its trademarks. Defts' are therefore prohibited from continuing to use, or oth erwise infringing upon, any of Pltf's marks, including Pltf's, Big Gulp, Slurpee, or any confusingly similar trademark, service mark, logo, or trade name, at least until adjudication on the merits of Pltf's action is complete. The Cour t DENIES Pltf's 9 Motion for P.I., insofar as it requests enforcement of the franchise agreement's "non-compete clause" prior to an adjudication on the merits.
