Filing 40 Judge Mark G. Mastroianni: MEMORANDUM AND ORDER entered. For the reasons set forth, Pltfs' Fair Housing Act Claims (Count I) are DISMISSED with prejudice, due to their failure to state a claim upon which relief can be grantred. The Court exe rcises its discretion to dismiss, without prejudice, Pltfs' remaining state-law claims (Counts II and III) as well. Accordingly, Defts' Motions for Dismissal [Dkt. Nos. 12, 25} are GRANTED. In light of this ruling, the remaining pending motions before the court [Dkt. Nos. 33 and 22} are DENIED because they have been rendered MOOT. The case may now be closed.
