MEMORANDUM AND ORDER granting in part Defendant/Cross-Claimant John Cunniff's 54 Motion for Appropriate Sanctions Against Cross-Claim Defendants Hunt Marine I, LLC; Hunt Tugs and Barges, Inc.; and Kevin M. Hunt for Failure to Comply with an Order of this Court, Failure to Provide Any Discovery Responses and Failure to Provide Initial Disclosures. -- The clerk is directed to enter (as to John G. Cuniff's Crossclaim; as amended at 37 : (1) default on counts II, IV, and VI; (2) a f inding of default liability on counts I, III, V, and VII; (3) a declaratory judgment on counts VIII and IX. (The Court's declarations as to the declaratory judgment are listed in the "Conclusion" section of the attached Memorandum and Order at pages 4 and 5.). So Ordered by Judge Mary M.
