PARTIAL RECOMMENDED DISPOSITION recommending that Everett be allowed to proceed with his 1983 claims against Corporal Dykes, Sergeant Ian Ward, Warden Pierce, Warden Nurzuhul Faust,Sergeant Alexander Delgado, Major Keith Day, and ADC Director Dexter Payne, in their individual capacities, and that the Complaint #2 be served on them. Everett's claims against defendants, in their official capacities be dismissed, without prejudice. The Court should certify that an in forma pauperis appeal from any Order adopting this Recommendation would not be taken in good faith. Objections due 14 days from the date of this recommendation.
